These Terms of Use ("Terms") govern your access to and use of the ePropelled website (the "Site"), including all content, services, and products offered by ePropelled through the Site (collectively, the "Services"). By accessing or using the Site, you agree to be bound by these Terms, as well as any other policies, guidelines, or rules that are posted on the Site.

If you do not agree to these Terms, please do not use the Site or Services.

1. Acceptance of Terms

By accessing or using the Site, you agree to be bound by these Terms, including any future modifications. ePropelled may update or modify these Terms at any time, and such changes will be posted on this page. You are responsible for reviewing these Terms periodically, and continued use of the Site after changes are posted constitutes your acceptance of those changes.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use this Site. By using the Site, you represent and warrant that you are of legal age to form a binding contract, or that you are using the Site under the supervision of a parent or legal guardian.

You are responsible for maintaining the confidentiality of your account credentials, and you are fully responsible for all activities that occur under your account.

4. Product Information and Availability

ePropelled makes every effort to provide accurate and up-to-date product information, including pricing, descriptions, and availability. However, we cannot guarantee that all information on the Site is error-free, complete, or current. ePropelled reserves the right to modify product details, prices, and availability without prior notice.

5. Purchases and Payments

By placing an order on the Site, you agree to pay for the products and any applicable taxes, shipping fees, and other charges associated with your order. All transactions are subject to availability and acceptance by ePropelled.

You shall be responsible for and pay directly when due and payable all taxes, duties, fees, or other charges of any nature (including, but not limited to, ad valorem, consumption, excise, franchise, gross receipts, import, license, property, sales, stamp, storage, transfer, turnover, use, or value-added taxes, and any and all items of withholding, deficiency, penalty, addition to tax, interest, or assessment related thereto), other than Taxes imposed by any governmental authority on ePropelled or its employees or subcontractors due to the execution of any agreement or the performance of or payment for work hereunder ("Buyer Taxes"). All payments due and payable by you hereunder shall be made in the full amount of the Contract price, free and clear of all deductions and withholding for Buyer Taxes. If you deduct or withhold Buyer Taxes, you shall pay additional amounts to ePropelled to cause the amounts ePropelled actually receives, net of deducted or withheld Buyer Taxes, to equal the full Contract price. You shall provide to ePropelled within one-month accurate official receipts from the appropriate governmental authority for deducted or withheld taxes.

ePropelled accepts various payment methods, including credit and debit cards, and other methods as indicated on the Site. You agree to provide accurate payment information and to comply with the payment terms of your chosen method.

6. Shipping and Delivery

Shipping and delivery times are estimates and may vary depending on location and availability. ePropelled will make reasonable efforts to fulfil orders promptly, but we do not guarantee specific delivery dates. Shipping costs will be calculated at checkout and are your responsibility unless otherwise stated.

7. Returns and Refunds

8. Intellectual Property

All content on the Site, including but not limited to text, images, graphics, logos, trademarks, and software, is the property of ePropelled or its licensors and is protected by intellectual property laws. You may not use, reproduce, duplicate, copy, distribute, license, lease, sell, resell, transfer, publicly display, perform, transmit, stream, broadcast or otherwise exploit any portion of the Website or other Services; or distribute any of this content without express permission from ePropelled.

Without our prior written consent, you must not;-

modify or alter the Website or the Services (including future versions) in any way other than through the configuration options we provide;
reverse engineer, disassemble or decompile, or attempt to reverse engineer, disassemble or decompile the Website or the Services (including future versions), in whole or in part;
remove, circumvent, disable, damage or otherwise interfere with security-related features that prevent or restrict use or copying of any portion of the Website or the Services or attempt to do so;
remove or delete any copyright, trademark or other proprietary rights notices from any portion of the Website or the Services;
or use our names, logos, product and service names, trademarks or services marks.

9. Prohibited Activities

Notwithstanding any other provisions, you shall timely obtain any required authorization, such as an export license, import license, foreign exchange permit, work permit or any other governmental authorization, even if ePropelled applies for the authorization. You shall be solely responsible for obtaining, maintaining and/or effectuating any governmental authorizations or notifications, including, without limitation, the required air permit modifications, if any, required for the lawful performance of the Services at the Site.

You agree not to engage in any of the following prohibited activities:

Violating any applicable laws, rules, or regulations.
Impersonating any person or entity or falsely stating or misrepresenting your affiliation with any person or entity.
Using the Site for fraudulent, harmful, or illegal purposes.
Interfering with or disrupting the Site or its servers or networks.
Engaging in any activity that could harm, disable, overburden, or impair the Site.
Publishing, making available, uploading, distributing or disseminating viruses, Trojan horses or other malicious code through the Website or Services;
Scraping the Website or Services by means of automated scripts;
Circumventing or attempting to circumvent any security measures or other technical limitations or restrictions of our Website or Services or attempting to gain unauthorized access to the Website, the Services or any connected networks.

10. Limitation of Liability

You understand that to the extent permitted under applicable law, in no event will ePropelled or its officers, employees, directors, parents, subsidiaries, affiliates, agents, partners or licensors be liable for any damages, be it direct or indirect, incidental, special, consequential, punitive or exemplary damages, including but not limited to, damages for loss of revenues, profits, goodwill, use, data or other intangible losses (even if such parties were advised of, knew of or should have known of the possibility of such damages, and notwithstanding the failure of essential purpose of any limited remedy), in connection with or otherwise resulting from any use of the website or the services, regardless of whether such damages are based on contract, tort, warranty, statute or otherwise. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain damages. You agree to indemnify, defend, and hold harmless ePropelled, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, costs, and expenses (including attorneys' fees) arising out of or in connection with your use of the Site, violation of these Terms, or violation of any rights of another party.

The Site may contain links to third-party websites or content. ePropelled does not control or endorse any third-party websites or content and is not responsible for their availability, accuracy, or content. If you decide to access any third-party websites or content, you do so at your own risk.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).

15. Termination

ePropelled may, in its sole discretion, suspend or terminate your access to the Site or Services at any time and without notice, for conduct that violates these Terms or is otherwise harmful to ePropelled, other users, or third parties.

16. Miscellaneous

Entire Agreement: These Terms constitute the entire agreement between you and ePropelled with respect to the use of the Site and Services.
Severability: If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.
Waiver: The failure of ePropelled to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
No Warranty: The website and the services are provided on an “as is” and “as available” basis without warranty or representation of any kind (express or implied) including warranties of merchantability, fitness for usage for a particular purpose, non-infringement, suitability for a particular cause, quality, timeliness, reliability or availability ePropelled expressly disclaims any representation or warranty that the website or the services will be available uninterrupted or error-free, without viruses or other harmful components. You assume all risks of damages that may occur as a result of using the website or the services.
Furthermore, you agree that you are using the website and the services at your own discretion and risk, and that you are solely responsible for any personal injury, death, damage to your property, damage to third-party property, violation of laws, rules or regulations, loss of data or compromise of your or third-party information and privacy.
